Service Description
AI Music Studio is an AI-powered music generation platform that allows users to create professional-quality music tracks using Google's Gemini API. Our service operates on a Bring Your Own Key (BYOK) model.
BYOK Model
- You must provide your own Google Gemini API key
- You are responsible for all API usage and associated costs
- We do not store or have access to your API key
- All processing happens client-side in your browser
- The service is free; you only pay for your API usage to Google
User Responsibilities
By using our Service, you agree to:
- Provide accurate and complete information
- Maintain the security of your API key
- Use the Service in compliance with all applicable laws and regulations
- Not use the Service for any illegal or unauthorized purpose
- Not attempt to gain unauthorized access to any part of the Service
- Not interfere with or disrupt the Service or servers
- Not use the Service to generate content that infringes on intellectual property rights
- Not use the Service to create harmful, offensive, or inappropriate content
Intellectual Property Rights
Platform Ownership
The Service, including its original content, features, and functionality, is owned by AI Music Studio and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Generated Content Ownership
You retain all rights to the music and content you generate using our Service. However, please note:
- Content is generated using Google's Gemini API, subject to Google's terms
- You are responsible for ensuring your use of generated content complies with applicable laws
- We make no warranties regarding the originality or copyright status of generated content
- You should review Google's AI-generated content policies
100% Copyright-Free Music
All music generated through our platform is created by AI and is considered 100% copyright-free for your use. This means:
- You can use generated music for personal projects
- You can use generated music for commercial projects
- You can modify and adapt the generated music
- No attribution is required (though appreciated)
- You are responsible for ensuring compliance with your local laws
Disclaimers and Limitations
Service "As Is"
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
No Guarantee of Availability
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
Third-Party Services
Our Service relies on Google's Gemini API. We are not responsible for any issues, outages, or changes to third-party services. Your use of Google's API is subject to Google's terms and conditions.
Limitation of Liability
To the maximum extent permitted by law, AI Music Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or other harmful code transmitted through the Service
- Any errors or omissions in any content or for any loss or damage incurred from use of content
- API costs incurred through your use of Google's Gemini API
API Usage and Costs
Important: You are solely responsible for all costs associated with your Google Gemini API usage:
- Monitor your API usage through Google Cloud Console
- Set up billing alerts to avoid unexpected charges
- Review Google's API pricing before extensive use
- We are not responsible for any API costs you incur
- We do not provide refunds for API usage
Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. Since all data is stored locally in your browser, you can clear your data at any time by clearing your browser's local storage.
Governing Law
These Terms shall be governed and construed in accordance with applicable international laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.
